AFSM 100 Automatic Induction & Automatic Tray Handling Systems Update

We have been reporting for some time that the AFSM 100s at the Denver General Mail Facility are scheduled to be retrofitted with “Automatic Induction” and “Automatic Tray Handling” systems that would reduce and/or eliminate the need for manual loading and sweeping of these machines. Based on the best available information, it appears that the AI system may be installed sometime in the middle of 2006. It is unclear when the ATHS system will be installed, although there is a deployment schedule showing it arriving in 2006. These modifications will almost certainly result in significant staffing reductions in the AFSM 100 operation on all tours. We will most likely experience excessing and abolishing from these sections.
As always, we will do everything in our power to ensure that the contractual rights of all impacted employees are protected to the maximum possible extent. We will also strive to minimize the adverse impact on these individuals. Remember that the union plays no part in planning operational changes, which are fully controlled by management. We cannot prevent these changes from happening, but we can police the contract and guard your rights. As we work through these issues and other challenges that lie ahead, please be aware of and appreciate the outstanding protections our contract provides. While some of you may lose your current duty assignments, your pay, benefits and job security will be fully preserved.
No other union contract anywhere in the world offers these kinds of guarantees. While some of you will experience disruption and inconvenience, we are truly fortunate and blessed to have the contractual rights we enjoy.
USPS Seeks Waiver of Driving Safety Rule

In an action that could have serious safety implications, the USPS has applied for an exemption from a Department of Transportation rule that limits the number of hours that drivers can spend at work. If the waiver is approved, Highway Contract Route (HCR) drivers would be permitted to drive more than 11 hours in a day and could be at work (driving and on standby) in excess of 14 hours. HCR drivers work for private mail-carriers under contract with the USPS. The request for the waiver may also be part of USPS efforts to reconfigure mail-processing operations. The change would give the Postal Service more flexibility in its consolidation efforts, allowing it to merge operations in plants that are even farther apart. In that case, an exemption from the hours-of-service rule would impact all APWU crafts.
The DOT’s Federal Motor Carrier Safety Administration will accept comments on this issue until Dec. 16, 2005. The fast-approaching deadline makes this a matter of extreme urgency. The APWU is asking members — and citizens concerned about highway safety — to submit comments in one of the following ways:

Morning Dispatch, Evening Close-Out
The Postal Service is arguing that the rule change will increase efficiency by permitting the same driver to perform both the morning dispatch and the evening close-out. This would allow the HCR drivers doing the evening close-out and the morning dispatchers to drive additional distances on each trip without being in violation of the rules. Adding drive-time hours makes it easier to consolidate facilities and also will eliminate jobs. Drivers would have very long standby time under extended-hours tours, which is likely to impact highway safety and even the safety of residential streets. Those working “split shifts” will be able to get other jobs to work “in between.” Since the Postal Service does not track driver hours, there will be no way to know how many hours operators are putting in behind the wheel each day. The Hours-of-Service were reduced because study after study showed that fatigue is a major factor in highway accidents involving heavy trucks.
In January 2004, the Department of Transportation disapproved a request by the National Star Route Mail Contractors Association for an exemption from the hours-of-service rule. MCA is one of the principal private mail carriers that would be affected if the USPS request is granted. The APWU is asking local and state organizations to utilize their network to get as many members, friends, and safety-conscious citizens to join in this fight to protest the waiver of the limitation of Hours-of-Service.

This is the beginning of a nationwide initiative to reduce the total number of processing facilities to adapt to reduced mail volume and increased productivity. So far, it appears the Denver District is unaffected. However, it is clear that thousands of APWU jobs will be impacted and that the lives of many employees will be disrupted by excessing and abolishing. We will continue to monitor this process and pass along new information as it becomes available.
Membership Votes to Send Three Additional Convention Delegates

At the regular meeting on Saturday, November 26, 2005, the membership voted unanimously to send three additional delegates to the 2006 APWU National Convention in Philadelphia, Pennsylvania. This vote was taken in accordance with the Denver Metro APWU’s Constitution and Bylaws. A delegate election will occur during the February 2006 membership meeting on Wednesday, February 22, 2006 from 5:00 PM until 7:00 PM. Nominations for the delegate election will be accepted at the membership meeting on Saturday, January 28, 2006 beginning at 9:00 AM. There will be three general delegate slots available along with two Associate Office delegate positions. Candidates for Associate Office delegates must be actively employed in a Denver Metro APWU Associate Office. Candidates for General delegates may come from any office and any craft within the local’s jurisdiction. Please be sure to attend the February union meeting so you can participate in our delegate election!
USPS Granted Rehearing on FMLA Ruling

A U.S. Appeals Court has granted a Postal Service petition for a rehearing in a landmark court decision that invalidated return-to-work requirements for employees with absences of more than 21 days. The appeals court action vacates the July 19, 2005, ruling that had been hailed as a major victory in the fight to preserve workers’ rights under the Family and Medical Leave Act (FMLA).
The USPS petition, filed Sept. 2 in the U.S. Court of Appeals for the Seventh Circuit, requested "reconsideration and rehearing," contending that a three-judge panel "erred" in its decision overturning the return-to-work policy.
The three-judge panel had annulled the requirement that employees provide detailed medical documentation or submit to a medical examination by a physician selected by the Postal Service before returning to work from approved FMLA absences.
The July ruling concluded that the Postal Service’s procedures were unlawful because they required a more onerous burden to return to work than was allowed under the FMLA statute, which required only a simple medical certification of fitness for duty from the employee’s own medical services provider. (Rodney Harrell v. USPS, No. 03-4204).
The U.S. Department of Labor has joined the Postal Service’s request for rehearing, arguing that both the law and the Department of Labor’s implementing regulations support their interpretation of the return-to-work rules.
The decision to vacate the July 19 ruling means that the same three-judge panel that heard the case initially will rehear the case. The Court asked the parties, including the Secretary of the Department of Labor, to file briefs and to be prepared to argue on the narrow issue of whether the Department of Labor’s regulations are sufficiently specific to warrant judicial deference to them. Briefs are due on Dec. 1; oral arguments will be presented on Dec. 9.
"It is the APWU’s belief that the clear, consistent language of the Family and Medical Leave Act supports the panel’s ruling," said APWU President William Burrus. The APWU’s attorneys are representing the plaintiff in this case.
Transitional Employees To Be Separated

In accordance with the Goldberg Interest Arbitration Award a few years ago, all non-REC site Transitional Employees must be separated by no later than December 31, 2005. This “sunset” date is nearly upon us, and management has given notice that all Denver District TE’s will be separated by no later than Friday, December 23, 2005. Our hearts go out to these individuals, but the APWU never agreed with the creation of this category of employees, who do not enjoy career status. Fortunately, many former TE’s have taken the entrance examination and been hired as career employees. Unfortunately, we could not persuade management to hire our current TE’s in CFS as career clerks, even though there remains a demonstrated need for these employees in the future. This process of separating non-REC site TE’s represents the closing of an unfortunate chapter in the history of the Postal Service. The APWU hopes this chapter is never again reopened.
Golden PTF Conversion Follow Up

Recording Secretary Gail Kirby reports that Golden Steward Mark Kraut was instrumental in achieving this union victory.
